2. Services

WebConsulting provides website creation (rental model), redesign, SEO, GEO (optimization for generative AI), Google Business Profile management, maintenance, and community management services for businesses and professionals. Created websites are rented to the client: WebConsulting retains ownership of the code and creations, the client pays a monthly fee covering hosting, maintenance and support. These terms apply exclusively to professionals acting for the purposes of their business.

3. Quotes and orders

Every project is subject to a detailed written quote, valid for 30 days. The order is confirmed upon receipt of a signed purchase order and payment of the setup fees. The quote serves as the contract.

4. Pricing and payment

Prices are in euros, net, VAT not applicable.

  • Website rental : monthly rent charged at the beginning of the month. One-time setup fees may apply depending on the plan. Annual plan: 12 months of rental billed at the price of 10, paid in one instalment at the start of the period.
  • Recurring services : monthly invoicing at the beginning of the month.
  • Digital Diagnostic : full payment before the session.

Payment by bank transfer. Any late payment incurs penalties at the current legal rate, plus a flat-rate recovery fee of €40 (article L.441-10 of the French Commercial Code).

5. Setup times

Setup times are specified in the quote and run from receipt of the setup fees and required materials (content, access, credentials). Any delay by the client in providing materials suspends the timeline.

6. Commitments

  • Quality check protocol : before every launch: speed, mobile display, forms, basic accessibility, indexability. Any non-compliant item is fixed before launch.
  • Operated site : hosting, maintenance, updates and support included in the monthly rent. The site remains the property of WebConsulting.
  • Post-launch adjustments : 30 days of adjustments included from the launch date.

7. Right of withdrawal

These terms apply to professionals: the right of withdrawal under the French Consumer Code does not apply. Exception: a client employing 5 people or fewer has 14 days to withdraw when the contract is concluded off-premises (for example during a meeting at their premises) and its subject falls outside their main line of business (article L.221-3 of the French Consumer Code). The withdrawal form is then attached to the quote. If such a client asks for the service to start before the period ends, they remain liable for the amount corresponding to the service provided up to their withdrawal (article L.221-25).

8. Termination of rental

The website rental has a minimum term of 6 months from go-live. It can then be terminated at any time in writing, with 30 calendar days' notice; termination takes effect no earlier than the end of the minimum term. At the end of the notice period, the site is taken offline. The client retrieves: their domain name if they financed it (transfer code provided within 15 days of a written request); their content (text, images, logo), returned in a standard format within 15 days; the requests received through the forms, which are sent to them and then deleted from WebConsulting's systems within 30 days. Email accounts stay active during the notice period so messages can be exported. The client's third-party accounts (Google Business Profile, analytics tools) belong to them: WebConsulting removes its own access. The code, design and technical components remain the property of WebConsulting (article 9) and may be reused on other projects, without the client's content, brand or data.

9. Intellectual property

The code, design and technical creations produced by WebConsulting remain its exclusive property. The client rents the right to use the site for the duration of the rental. Content (text, images, logo) provided by the client remains their property. WebConsulting reserves the right to mention the project in its portfolio, unless expressly objected to by the client.

10. Liability

WebConsulting cannot be held liable for indirect business losses, service interruptions attributable to the hosting provider, or modifications made by the client to the delivered code without prior agreement.

11. Applicable law and disputes

These T&Cs are governed by French law. The parties first seek an amicable solution, within 30 days. Failing that, the dispute is brought before the court with jurisdiction under the ordinary rules.

12. Data processed on the client's behalf

For the forms on the rented site, the client is the data controller and WebConsulting acts as processor (article 28 GDPR). WebConsulting processes this data only to run the site and forward requests to the client, according to the instructions set by the quote and these T&Cs. WebConsulting keeps it confidential, applies appropriate security measures, hosts it in France with o2switch (sub-processor authorised by the client), helps the client answer data subject requests, notifies any data breach without undue delay and makes available the information proving compliance with these obligations. At the end of the rental, the data is handed over then deleted as set out in article 8.
